By accessing or purchasing from jollyngifts.com, you agree to these Terms of Service. jollyngifts.com is operated by Zyphoria Ventures LLC, a Wyoming limited liability company located at 805 CY Ave, Casper, WY 82601, United States. In these terms, "we", "us" and "JollynGifts" mean Zyphoria Ventures LLC.

If you do not agree with these terms, please do not use the website or place an order.

2. Eligibility

Who can order

You must be at least 18 years old to place an order. You must provide a valid delivery address in the United States or the United Kingdom, and accurate contact and payment information.

3. Our Products

Made-to-order apparel and shoes

We sell adult apparel, T-shirts, hoodies and shoes. Every item is printed to order and produced upon order by our production partner in the United States.

Colors on your screen may look slightly different from the printed item because of screen settings and printing methods. Size charts on product pages are a guide, and small differences in measurements can occur.

Because items are made to order, production starts after payment is confirmed. Processing takes 2–5 business days (Mon–Fri, 9:00 AM – 5:00 PM MT).

4. Orders and Acceptance

How an order is accepted

When you place an order, you make an offer to buy. We accept it when we send you an order confirmation email.

We may refuse or cancel an order because of a pricing error, suspected fraud or a delivery address outside the United States and the United Kingdom. If we cancel, we refund any payment in full.

5. Prices and Payment

Paying for your order

Prices are shown in US dollars for US orders and in British pounds for UK orders. PayPal is our accepted payment method. PayPal accepts Visa, Mastercard, American Express, Discover via Guest Checkout.

United States: The price displayed is the final product price. Any applicable sales tax, if required by your state, will be calculated at checkout.

United Kingdom: VAT is collected at checkout.

6. Shipping

Delivery terms

We ship only to the United States and the United Kingdom. All orders are produced and shipped from the United States. Shipping is a flat rate of $4.95 in the US and £4.95 in the UK.

Processing takes 2–5 business days and delivery takes 3–5 business days, for a total of 5–10 business days. Business days are Monday - Friday, excluding public holidays. Our business hours are Mon–Fri, 9:00 AM – 5:00 PM MT. Delivery times are estimates. Full details are in our Shipping Policy.

7. Returns, Refunds and Cancellation

Our return terms

We offer a 30-day return policy for defective and non-defective items. Return shipping is free for change-of-mind and sizing returns. Orders can be cancelled only before they enter production.

8. Intellectual Property

Who owns the content

All designs, text, images, logos and other content on jollyngifts.com are owned by Zyphoria Ventures LLC or used under license. You may not copy, reproduce, sell or distribute our content or designs without our written permission.

Buying a product gives you the right to use and wear it. It does not transfer any rights in the design.

9. Acceptable Use

Using our website

When you use our website, you agree not to:

Break any law or these terms
Place orders with false information or a payment method you are not allowed to use
Try to access our systems, accounts or data without permission
Upload or send harmful code, spam or abusive messages
Copy or scrape site content by automated means

We may block access to anyone who breaks these rules.

10. Disclaimer

Website availability

Our website is provided on an "as is" and "as available" basis. To the extent the law allows, we disclaim implied warranties about the website, including uninterrupted access.

This does not limit our obligations for defective, damaged or wrong items under our Return & Refund Policy, or any statutory rights you have.

11. Limitation of Liability

Limits on our liability

To the extent the law allows, our total liability for any claim related to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited by law.

12. Indemnification

Your responsibility

You agree to cover any claims, losses or costs, including reasonable legal fees, that result from your breach of these terms or your misuse of the website, to the extent the law allows.

13. Governing Law

Which laws apply

United States

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Any dispute will be handled by the state or federal courts located in Wyoming.

United Kingdom

If you are a consumer living in the United Kingdom, you keep the protection of the mandatory laws of the part of the UK where you live, including the Consumer Rights Act 2015. Nothing in these terms removes those rights. You may also bring a claim in the courts of England and Wales, Scotland or Northern Ireland, depending on where you live.
